Terms of Service
These terms govern your use of Elyptis AI ("Elyptis," "we," or "us"), an AI-powered lead-response service for real estate agents, operated by Jacobe Delcastillo, a sole proprietorship based in Port St. Lucie, Florida. By using the service, you agree to these terms.
What the service does
Elyptis connects to a real estate agent's email, calendar, and inbound lead channels (website forms, listing-portal inquiries) and uses an AI assistant to reply to new leads, qualify them in a short conversation, and book demo or showing slots on the agent's calendar. The agent receives a daily briefing summarizing leads and recommended next actions.
Who can use the service
Elyptis is intended for licensed real estate professionals operating in the United States. By using the service, you represent that you are at least 18 years old, are authorized to enter into these terms on behalf of yourself or the business you represent, and will use the service only for lawful business purposes.
Your account and authorizations
To use the service, you grant Elyptis specific permissions through Google's OAuth flow:
- Send mail on your behalf from the Gmail or Google Workspace address you authorize. We do not read your inbox or modify any other messages.
- Read your calendar's free/busy information and create new events on the calendar you authorize. We do not read existing event details (titles, attendees, descriptions) beyond what is required to confirm a slot is still free at booking time.
You can revoke either authorization at any time from your Google Account settings. Revocation immediately stops the service for that channel.
You are responsible for keeping your contact and authorization information accurate, and for the security of any credentials you share with us during onboarding.
Your data
Elyptis stores conversation transcripts, lead contact information, and configuration data necessary to operate the service on your behalf. This data lives in your own Notion workspace, which you own and control. Elyptis is invited as a guest integration and can be removed by you at any time.
We do not sell your data, do not share it with advertisers or data brokers, and do not use your data or your leads' data to train AI models. See our Privacy Policy for full details on what we collect and how we use it.
Acceptable use
You agree not to use the service to:
- Send unsolicited messages to recipients who did not initiate contact with your business.
- Misrepresent the AI assistant as a human, instruct it to lie about its nature, or impersonate another person or business.
- Send messages that violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state-level marketing laws, fair-housing laws, or any other applicable law or regulation.
- Attempt to reverse-engineer, scrape, abuse rate limits, or otherwise interfere with the service's operation.
- Use the service to discriminate against any protected class in real estate transactions or marketing.
You are responsible for the messages sent from your authorized accounts under your direction, including those drafted by the AI on your behalf and approved (explicitly or implicitly) for sending.
Fees and billing
Pricing is communicated in writing during onboarding and confirmed in your subscription invoice. A one-time setup fee covers initial configuration, OAuth provisioning, voice tuning, and the first 7 days of monitoring. The monthly subscription fee covers ongoing service operation.
Fees are billed monthly via the payment method you provide. Failed payments may result in service suspension after a 7-day grace period. Unused portions of any month are not refundable, except where required by law.
Termination
You may cancel the service at any time by emailing Jacobe@elyptis.ai. Cancellation takes effect at the end of the current billing period; you are not charged again, and the service stops at that time. Upon cancellation:
- Your Notion workspace, including all leads and conversation history, remains entirely with you.
- Elyptis revokes its bot access to your Notion workspace within 30 days.
- You may revoke OAuth permissions in Google Account settings immediately.
- Any per-client server-side configuration we hold is deleted within 30 days, except where retention is required by law or for compliance records.
We may suspend or terminate service to any account that we determine, in good faith, is being used in violation of these terms or applicable law. We will provide written notice and a reasonable opportunity to cure where the violation is curable.
Service availability and changes
Elyptis is operated as a small business service and is not a guaranteed-uptime SaaS product. We make reasonable efforts to keep the service running but do not guarantee specific uptime, response time, or freedom from interruption. We may add, change, or remove features as the service evolves; material changes will be communicated in advance where reasonably possible.
We rely on third-party services (Google, Anthropic, Notion, Cloudflare, Twilio) whose own outages or policy changes may affect Elyptis's ability to deliver the service. We are not liable for failures caused by these providers.
No warranty
Elyptis is provided "as is" and "as available." We do not warrant that the AI's qualifying decisions, lead scoring, or message drafts will be accurate, on-brand, or appropriate in every case. You are responsible for reviewing the service's output and for any actions you take based on it. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, Elyptis's total liability for any claim arising out of or related to these terms or the service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost business, lost commissions, or lost goodwill, even if advised of the possibility.
Indemnification
You agree to defend and indemnify Elyptis against any third-party claim arising from your use of the service in violation of these terms or applicable law, including claims that messages sent through your authorized accounts violated the TCPA, fair-housing law, or any other consumer-protection statute.
Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these terms will be resolved in the state or federal courts located in St. Lucie County, Florida, and you consent to the exclusive jurisdiction of those courts.
Changes to these terms
If we make material changes, we will update the "Last updated" date at the top of this page and notify subscribed agents by email at least 14 days before the changes take effect. Continued use of the service after the effective date means you accept the revised terms.
